EVICTIONS
As most residents are aware, the Board of Directors has the responsibility to the members to revise and update general policies concerning Scottsdale East Homes, Inc. A recent review of the eviction procedures reveals that they are not sufficiently definitive to protect the members of the corporation. During a meeting the Board unanimously agreed to implement the following:
- Reasons for Evictions:
- Failure to pay the Carrying Charges or any charges due in a timely manner.
- Violation of Occupancy Agreement such as, but not limited to, excessive noise, structural changes not previously approved by the Board, pets, unregistered occupants, loud disturbances, unruly conduct, etc.
- Procedure:
- Five day notice of default will be sent to member.
- Notice is also sent to the attorney representing the Co-op.
- The matter will be turned over to our attorney if no actions are taken to cure the notice of default.
If the member does not cure the default, the Corporation will pay the median price to the former member less the estimated repair costs necessary to return the unit to "like new condition" and less 12 months carrying charges. Itemized accounts will be kept of all costs (including the carrying charges) expended to refurbish the unit and to pay the carrying charges until the unit is sold. Those funds originally retained, but not expended in refurbishment, etc., will be returned to the former member with an itemized account of all funds used.
In the event of an eviction for nonpayment of carrying charges, the default will be reported to the Credit Bureau.
Should the matter go to court, S.E.H. will also subtract all attorney and court costs in addition, prior to final payment.
This will clarify the exact procedures to be used in the eviction proceedings.
